The changes to the NDIS legislation that came into effect on Thursday, 3 October 2024, bring about several improvements designed to streamline support and ensure participants get the right services tailored to each individual’s needs.

At Momentum Collective we understand that change can be daunting and we want you to know that these updates will provide high level information on what has been proposed and we will share any changes to the services we provide when more information is available from the NDIS.

Here is some general information of the primary changes from the NDIS.

SEPERATE PATHWAYS

The NDIA will now assess whether a person with a disability meets the disability requirements, the early intervention requirements, or both.  This improvement supports the development of new pathways, ensuring a participant gets the most relevant support.

What it means for participants: If a participant qualifies for early intervention, participants will soon have access to a tailored pathway focused on providing the proper support at the right time, empowering the participant to achieve goals sooner.

SUPPORTS FOR IMPAIRMENTS
The NDIS will now only fund supports related to the impairments the participant qualifies for when accessing the scheme.

What it means for participants: This ensures a participant’s NDIS plan is focused on the supports that will make the most significant difference to their life, helping the participant make the most of the NDIS funding.

NDIS SUPPORTS
A new definition of NDIS supports has been introduced, meaning a participant can only use NDIS funds for services recognised as NDIS supports. In addition, a substitution rule will enable participants to request to substitute non-NDIS supports in individual circumstances.

What it means for participants: This clarification makes it easier to understand what the participant’s funds can be spent on. The substitution rule allows the participant to request non-NDIS support if it suits the participants needs, offering choice and control over the plan.

A comprehensive list of NDIS supports and Non-NDIS supports can be found here.

TOTAL FUNDING AMOUNTS AND PERIODS
New plans (approved after 3 October 2024) will now include precise total funding amounts and specific funding periods, with unused funds able to roll over within a plan’s funding period.

What it means for participants: This change provides more transparency and flexibility, assisting participants to better manage the NDIS funds across a plan period and ensuring nothing goes to waste.

Many other components of the NDIS have also seen changes through the reform. Click here for a summary of the legislation changes that will impact NDIS participants now and into the future.
